The easy eSignature (EES) is the lowest eSignature standard, with hardly any requirements. It can be created by scanning a handwritten signature, for example. This type of signature is primarily used for informal agreements or internal company transactions. It can be used for orders, contracts, documentation and minutes. While the EES can be used in court proceedings, it has little evidential value and can easily be disputed.
The advanced electronic Signature (AES) is the standard for electronic signatures and is created using an encryption process. It has a high probative value in court.
This signature must enable recognition of any manipulation of the document's data after signing, and must be clearly attributable to a specific person. This person must also be able to prove that they applied the signature and that it meets the relevant security requirements.
Unique and secret software keys that use digital signature procedures must be used for the advanced signature. The hash value created by the sender of the document is compared with the recipient's hash value to check whether they match.
The advanced electronic signature fulfils the requirements for electronic forms as defined in Section 127 of the German Civil Code (BGB) and has evidentiary value in court proceedings. It is often used for informal agreements that are not subject to stricter legal requirements.
A qualified electronic signature (QES) is the highest standard of electronic signature and involves stringent requirements, such as encryption and identity verification by certified bodies. It carries maximum probative value in court and is legally equivalent to a handwritten signature.
Unlike the advanced electronic signature, the qualified electronic signature also requires a certificate from a certification service provider that uses asymmetric encryption methods. To be approved as a signature issuer, an applicant must submit a written application to a provider, who will verify their identity and confirm that they have a public signature key that matches their identity. The certificate is usually valid for a limited period, typically 2–3 years but no more than 5 years.
A qualified electronic signature fulfils the written form requirements of § 126a of the German Civil Code (BGB) and can therefore replace paper documents.

First, we guide customers through a digital registration process where all data is stored, opt-ins are granted, and the application is confirmed with an e-signature. If APIs are available, the process can be initiated via the Broker Relationship System, and the data can be transferred.
In the second step, Agree&Sign validates the data using methods such as a Creditreform query, an IHK validation, and an Avad query.
In the third step, we seamlessly integrate all collected data, documents, and validations into your systems via interfaces.
